Three Levels of Fees

If you file a patent in the United States, you are one of these three entities.

  • Large Entity = Pay full fee amount (default)
  • Small Entity = 60% discount
  • Micro Entity = 80% discount

Applicants and Inventors

To qualify as a small or micro entity, the applicant and all co-inventors must meet certain requirements. Who is an applicant and inventor?

  • Applicant = Person who files the application
  • Inventor = Person who contributes to the conception of the invention

Small Entity Status

To qualify as a small entity, the applicant and all co-inventors must...

  • Be individuals OR
  • Be a business with less than 500 employees OR
  • Be a nonprofit

NOTE: If you already assigned your rights to a large entity, you cannot qualify as a small entity.

Micro Entity Status

To qualify as a micro entity, the applicant and all co-inventors must...

  • Have small entity status AND
  • Have less than five applications filed AND
  • Have gross income less than $223,740 (2024)

NOTE: If you already assigned your rights to a large or small entity, you cannot qualify as a micro entity.
